What is this document?

• The Terms, read together with our privacy policy, and returns and refunds, constitute a legal binding agreement between you and Cutecalf Corporation – a company incorporated according to the laws of India.
• The Terms of Use states the terms that governs you accessing our website and our applications (if any) that facilitate the purchase of baby merchandise and such other products sold by Cutecalf and any other service that may be provided by Cutecalf from time to time, referred to as ‘Services’ herein.
• You hereby agree to the Terms of Use - that it forms a binding between Cutecalf and anyone who accesses, browses, or purchases our products or uses our services. The terms mentioned herein shall be accepted without modification.

Terms and conditions applicable to customers

• People must be above 18 years or more to access and register our platform and use our services. By registering, visiting, or using our services, you hereby agree that you are 18 years of age or older, have the authority to use our services, and abide by our Terms of Use.
• Our Terms of Use are governed by different provisions of the Indian Law, but not limited to the Indian Contract Act 1872, the Information Technology Act 2000, the Information Technology – Intermediaries Guidelines Rules 2011, and the rules and guidelines laid under the Information Technology - Reasonable Security Practices and Procedures and Sensitive Personal Information Rules 2011.
• The contents of the website/ platform, including graphics, texts, logos, images, design, collection, and overall arrangement or any of our Services are the property of Cutecalf, group companies, subsidiaries, affiliates, subsidiaries, suppliers, and vendors, and are protected under copyright/ trademark and other applicable laws. You shall not modify, produce, display, copy, distribute, or otherwise use all that belongs to Cutecalf for any public or commercial purpose, or for your personal gain.
• Cutecalf authorises you to view products, carrying out purchases, and processing returns and refunds – all in accordance with our Return Policy. Cutecalf thus grants you a limited and revocable permission to access the platform and use our services. This does not include the permission to carry out resale of our products, use our product listings, use our descriptions, or any derivative use of our platform.
• As a means to assist customers, Cutecalf provides visual representations of products on the platform including images, illustrations, charts, videos, infographics, and other visual aids. While reasonable efforts have been made to provide accurate digital representations, Cutecalf disclaims any guarantee of exactness of such visual representation. The appearance of the products may vary due to many factors.
• Users may make purchases on the platform. However, for identifying users, Cutecalf may collect certain personally identifiable information, such as name, email address, phone number, postal address, etc. Users may also be asked to register on the platform. The registration process is a one-time process and you are required to remember your username and password.
• You agree to update all data provided by you and keep it accurate and current at all times. If the provided information is untrue or incomplete, or if Cutecalf has grounds to suspect the information or not in accordance with our Terms, Cutecalf reserves the right to suspend, or block your access to the platform.
• You understand that the registration on the platform may lead you to receive text messages, including through internet-based messaging platforms, and emails on your registered mobile number or email ID. Such emails and messages could relate to your registration, confirmation about a product purchase, product despatch information, details about a promotional event undertaken by the company from time to time.
• Any communication from Cutecalf shall be sent only to the registered contact number and/ or email address, or any such phone number or email ID that you may designate. Users shall be solely responsible to update their contact details on the platform. Cutecalf may send you reminders and updates with respect to scheduled deliveries. While Cutecalf shall make every endeavour to share notifications and reminders, the company shall not be held liable for failure to send reminders and notifications to you.
• Cutecalf may at any time without serving a notice, may update, change, or modify its products and services as it may deem fit and change the contents of the Terms and Conditions, which will be applicable to all users. You hereby agree that such changes are brought in for the fairness of things and that you’ll abide by them. Thus, you should keep yourself updated at all times and review the Terms of Use from time to time.
• While Cutecalf shall make reasonable effort to maintain high standards of security, Cutecalf shall not be responsible to any interruption that may be caused to your access of this platform and our services.

The user hereby confirms that all information provided by him or her is true and complete to the best of his or her knowledge. The user agrees that he or she will be solely responsible for any inaccuracy therefrom at a later stage.

User covenants and obligations

As mandated under the provisions of IG Rules, you are prohibited from hosting, displaying, modifying, uploading, publishing, and sharing any data that:

• Belongs to another person which you do not have right to.
• Is harmful, blasphemous, obscene, defamatory, pornographic, libelous, or invasive of other’s privacy, hateful, ethnically objectionable, encouraging money laundering or gambling, or harmful in any matter whatsoever.
• Harms minors.
• Infringes any trademark, patent, or other propriety rights.
• Violates any law.
• Misleads or deceives people or communicates any information that is menacing or offensive.
• Impersonates or defames other people.
• Contains malicious software/ software viruses or files and programs designed to destroy or disrupt or limit the functionality of our platform.

You are also prohibited from:

• Transmitting any information that is disruptive or competitive to Cutecalf and our provision of services.
• Attempt to violate the security and integrity of our platform and our products.
• Intentionally submitting false information on the platform.
• Attempt to decipher, disassemble, or reverse engineer any part of our platform.
• Copy or delete any part of our content.

You are obligated to:

• Refrain from acquiring rights of our content.
• Read the Terms of Use and accept the conditions mentioned herein.
• Comply with all applicable laws.
• Refrain from copying or modifying our content for any purpose.
• Not refuse the delivery of a product you’ve purchased unless it is damaged.
• Use the product for non-commercial use.

Cutecalf may disclose information shared by you to its affiliates, and you content to such information transfer.

Third-party information

All information available on the platforms pertaining to third parties – referred to as Third Party Information is solely provided for reference. Cutecalf is not responsible for any errors, nor is it in any way associated with them. You shall access third party information at your own risk.

It is up to you to take adequate precautions while selecting whatever links you click and whether such platforms are free of viruses, Trojans, and other destructive items.

Liability

You acknowledge that you are accessing our services and purchasing our products at your own risk and that you use prudent judgement before placing an order or availing our services. At no point, Cutecalf will be held responsible for any misrepresentation of our products. Refund for a cancelled product shall be governed by our Return and Refund policy.
